These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the Santa Chat mobile application (the "Service") operated by Plot Twist LLC ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our Santa Chat mobile application (the "Service").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of these terms then you may not access the Service.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to act unlawfully
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

AI Services and Third-Party Providers

Our Service utilizes artificial intelligence technologies provided by third-party services, including but not limited to OpenAI and ElevenLabs ("AI Providers"). By using our Service, you acknowledge and agree to the following:

OpenAI Usage

We use OpenAI's API to generate text and conversational responses. Your inputs may be processed by OpenAI's systems. You agree not to use the Service to generate content that violates OpenAI's Usage Policies, including but not limited to hate speech, harassment, violence, self-harm, sexual content, or political content.

ElevenLabs Usage

We use ElevenLabs for voice generation services. You agree not to use the Service to clone voices without consent or to generate audio that promotes hate speech, harassment, or illegal activities.

The output generated by these AI Providers is automated and may not always be accurate. You rely on such information at your own risk. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.

IMPORTANT: The Santa Chat application is designed for entertainment purposes only. The Service is not intended to replace human interaction or professional advice.

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

• Excludes all representations and warranties relating to this Service and its contents
• Excludes all liability for damages arising out of or in connection with your use of this Service

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You represent and warrant that:

• Content is yours (you own it) and/or you have the right to use it
• You have the right to grant us the rights and license as provided in these Terms

Intellectual Property Rights

The Service and its original content, features and functionality are and will remain the exclusive property of Plot Twist LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, USA, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Subscription Plans

• Weekly Plan: $5.99 per week
• Yearly Plan: $99.99 per year

Automatic Renewal & Cancellation:

• This is an auto-renewable subscription.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in your App Store account settings at any time.
• No refunds will be issued for the current subscription period.
